example??? its a really tricky thing to judge' date=' i am learning about this now in school and they use an abstraction scale to see how close to the original it is and so forth[/quote']

Take Rapunzel for instance. Who's too say that the reason Rapunzel is in the tower isn't because she is a sociopath who was found guilty of killing and eating her husband, and now she lures men to the tower to climb up so she can do the same to them.

well with that it seems like there are enough differences but if you have guys climbing up using her hair it may get a little tricky, copyright is a hard thing to judge really look up levels of abstraction for copyrights to try to get a better idea. a lot of it has to do with the original authors idea vs expression

That's what i've been looking for but everything is pointing me to plagiarism. Since im not going to be using a single sentence from the original authors work. Plagiarism isn't a problem.

However, since I would be using the original authors character and a few small plot points, copyright infringment could be a problem. Does that make sense at all?

there is a good chance some of the fairy tales might be public domain, so if you were re-writing those that are public domain you might be okay...

http://en.wikipedia.org/wiki/Public_domain

I think it also depends on the laws in your country, but hopefully the link above and some extra research can get you set...

there are many things that are re-hashed versions of public domain material...

Traditional knowledge includes pre-existing, underlying traditional culture, or folklore, and literary and artistic works created by current generations of society which are based on or derived from pre-existing traditional culture or folklore. Traditional culture and folklore tends to be trans-generational, old and collectively "owned" by groups or communities. Often traditional culture and folklore is of anonymous origin and expressions of this pre-existing traditional culture is generally not protected by current intellectual property laws and is treated as being in the public domain.

This paragraph makes it sound like I would be o.k because fairy tales fall under folklore from what I understand.

Like old ghost stories passed down from generation to generation etc. The ghost is always the same, but the story of how she became a ghost always changes.

Don't know anything about your original question but I think that the idea is really good.
